UK Immigration Law Update: Labour Government Introduces Stricter English Language Requirements
In May 2025, the Labour government released its White Paper, “Restoring Control over the Immigration System”, outlining a new vision for UK immigration policy. The government’s goal is to reduce net migration, strengthen integration, and ensure that the UK continues to attract highly skilled international talent.
Following this, the Home Office introduced two key updates to the Immigration Rules:
- Statement of Changes HC 997, effective 22 July 2025
- Statement of Changes HC 1333, effective 14 October 2025
These updates mark a significant shift in the UK immigration landscape — particularly in relation to English language requirements and skilled worker eligibility.
Why Have the Rules Changed?
The Labour government has emphasised the need for an immigration system that supports economic growth while ensuring that migrants can integrate effectively into British society.
The reforms aim to:
- Address skills shortages in key industries
- Improve social cohesion through higher language standards
- Ensure that only skilled and qualified workers enter the UK labour market
Key Immigration Changes Introduced
1. Higher English Language Requirement: B2 Level (from B1)
From 8 January 2026, all Skilled Worker Visa applicants will be required to demonstrate B2 Level English proficiency (equivalent to A-Level English).
Previously, applicants were only required to meet B1 Level (equivalent to GCSE level). The new requirement applies to all key skills — speaking, listening, reading, and writing — and must be evidenced through an approved Secure English Language Test (SELT) from Home Office-approved providers.
High Potential Individual (HPI) Visa holders must also meet these enhanced language standards.
2. Dependants Must Meet English Language Requirements
Dependants accompanying a main visa holder will now need to meet A1 Level English at the time of application.
Further requirements apply for those extending their stay:
- A2 Level for visa extensions
- B2 Level for Indefinite Leave to Remain (ILR) applications
This reform ensures that dependants can effectively integrate into UK society from the outset.
3. Skilled Workers Must Hold Qualifications at RQF Level 6 or Above
Under HC 997, Skilled Worker Visa eligibility now requires applicants to be qualified to at least RQF Level 6 (degree level or higher).
Employers must also ensure that the sponsored job role accurately reflects this level of skill and responsibility. This move aims to attract highly skilled professionals who can contribute meaningfully to the UK economy.
4. ILR English Language Requirements Updated
According to HC 1333, partners or parents who are unable to meet the English language standards set out in Appendix KoLL may still be granted permission to remain in the UK — but only for 30 months, and without access to public funds.
This change reinforces the government’s stance that English proficiency is an essential component of long-term residence in the UK.
What These Changes Mean for Migrants
These reforms collectively raise the standard for migrants entering and settling in the UK. By introducing higher English language thresholds and stricter qualification requirements, the government aims to:
- Encourage economic growth through skilled migration
- Reduce low-skilled migration
- Support stronger community integration
Migrants planning to apply for a Skilled Worker Visa, HPI Visa, or Indefinite Leave to Remain should prepare early to meet the new English language standards effective January 2026.
