The Background: A Journey Complicated by Compliance Issues

Our client originally arrived in the UK on a Student Visa. Like many, their circumstances changed, leading them to claim asylum. However, navigating the asylum system is difficult; due to a misunderstanding of the requirements, the client failed to comply with certain immigration rules.

As a result:

The Home Office withdrew the asylum claim.
The client was flagged for non-compliance.
The client was subsequently detained pending removal.

With a history of failure to comply, the odds of being granted bail were significantly lower, as the Home Office argued there was a high risk of the client absconding.

The Strategy: Building a Robust Bail Application

When the family reached out to us after searching for immigration bail experts, we knew we had to act fast to prove that our client was not a flight risk. Our strategy focused on three pillars:

The case was heard at the Tribunal. The Home Office representative argued strongly for continued detention, citing the withdrawn asylum claim and the previous history of non-compliance.

However, our legal counsel successfully argued that detention was no longer necessary or proportionate while further submissions are being considered.
