What Happens After Your Asylum Is Refused?

You will get a refusal letter from the Home Office. This letter explains why they didn’t believe your case. It may be because they think your asylum basis isn’t true, or they believe your country is safe for you to return.

This letter is very important. It also tells you if you have the right to appeal.

Can You Appeal the Asylum Refusal?

  • The Home Office may send a representative (a Presenting Officer)
  • You may be asked to speak about your case

Step 7: Waiting for the Result

After the hearing, you will get a letter with the judge’s decision.

  • If the appeal is allowed, you may be granted asylum or other protection.
  • If it’s dismissed, the judge agreed with the Home Office.

You’ll normally get the decision within a few weeks.

If You Lose the Appeal

If your appeal is dismissed, you can:

  • Ask the Upper Tribunal to look at your case, but only if there was a legal error
  • Try a Judicial Review, if you’re told you can’t appeal
  • Send in a fresh claim, if you have new evidence
